Security:

All data entered into our website is encrypted and is protected using SSL encryption software at a level equal to or better than most banks.

If you decide to save your card information when processing payment, it is stored in our processor's system and follows their advanced security measures.

KeepItDirect.ca uses Braintree to process credit cards. All customer data is collected on their secure web server and transmitted to the card network directly from Braintree's PCI certified solutions. Braintree employs a number of the latest fraud prevention techniques; if you are having trouble processing any of your cards please let us know so we can look into the problem.

Information Collection and Use:

Keep It Direct Contractor Supply Ltd. is the sole owner of information collected on this site. We will not sell, share, or rent this information to any outside parties, except as outlined in this policy. We collect information from our customers to process orders and better serve you with pertinent information, such as order confirmations and order status updates. Information collected includes your name, shipping address, billing address, telephone numbers, e-mail address, and payment information such as your credit card number. Orders

Most of the information collected will be used to process orders. During the order process, you will have to provide financial information such as your credit card number, expiration date, money order, e-transfer or check information. This information is used for billing purposes and to fulfill your order. If we have trouble processing an order, we will use this contact information to get in touch with you. To properly process your credit card information, we must share your personal and financial information with the merchant bank for authorization and approval. This process is protected by an enhanced security system. We do not share your personal and financial information with any third parties, except those specified in the Sharing section of this policy.

Cookies

If you choose to reject the cookie, you can still browse our store but will be unable to use the shopping cart to buy merchandise. Security

KeepItDirect.ca takes precautions to protect its customers' information. Choice/Opt-out

For customers who wish to opt-out and stop receiving KeepItDirect.ca special offers and related news, KeepItDirect.ca provides several ways to do so. Canadian Usage

KeepItDirect.ca may only be used by residents of Canada to order goods or services intended to be delivered to addresses in Canada. Use of KeepItDirect.ca is governed by the provincial and federal laws of Canada. The laws of your jurisdiction may be more or less strict than the laws that apply to KeepItDirect.ca. If you access KeepItDirect.ca from outside Canada, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

Bulk Discounts

Bulk discounts are offered to KeepItDirect.ca shoppers as a way to purchase larger quantities of items together at a discounted price. If part of an order is returned, discounts will be recalculated based off of the product kept. Bulk discounts can be maintained on an order where product is being returned by exchanging the unwanted product for other products from the same discount group. Usually, this will mean changing one size for another of the same product. Generally, all products in one discount group will be displayed on the same page with details about the discount.

Promo Codes

KeepItDirect.ca will sometimes furnish an alphanumeric code that can be used for promotions on our web site. These promotional codes may be found in print and/or online advertisements, sent via email to our Newsletter and/or Promotion subscribers, presented on the KeepItDirect.ca web site or circulated at events and through other means. Some of the specials offered by entering a Promo Code during checkout include free shipping, volume discounts or free gifts. The provisions for a Promo Code will be included with the code itself; if an expiration date or other condition is stipulated, just reference where you acquired the code for the exact requirements. Please note that Promo Codes are not redeemable for cash and you must spend more than the discount price in order for a promotion to be applied. For example, if a Promo Code offered $10.00 off your next purchase, you would need to spend more than $10.00 to redeem your discount.

Sales Tax

KeepItDirect.ca charges GST (HST on sale made into New Brunswick, Newfoundland & Labrador, Nova Scotia, PEI and Ontario) on all sales as required by law.

KeepItDirect.ca charges PST in British Columbia.

Purchases made outside of Canada are not taxed by KeepItDirect.ca and the purchaser will be responsible for all duties, tax and any other import charges/fees.

Product Testing

KeepItDirect.ca, like other e-tailers, ships items in the condition they were received from the original manufacturer/distributor. KeepItDirect.ca may check random samples visually but does not conduct product testing before shipping any merchandise.

Refund Policy

All merchandise unless otherwise indicated may be returned within 365 days from the original shipping date for a refund. A return authorization number is required for all returns. Customers must inform KeepItDirect.ca of any order discrepancy within 30 days from the invoice date so that we may investigate and resolve the situation accordingly.

Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. KeepItDirect.ca does not guarantee shipping estimates. Orders are not processed on weekends and holidays. Product delivery could be delayed due to Customs.

Back-Orders

KeepItDirect.ca does not regularly sell backordered merchandise. Occasionally due to supply issues we may give the option to backorder products but regularly we will remove a listing when a product is out of stock. Occasional inventory discrepancies may occur due to inaccurate inventory counts or possibly because the last few items on our shelves are damaged and/or not in a condition that we can in good faith sell to a customer. If you are erroneously charged for an out-of-stock item, we will issue a refund for the item, along with any applicable tax, fees and shipping charges. An automated email will also be sent to your KeepItDirect.ca login to alert you of the situation.

Order Status

KeepItDirect.ca will keep you informed of your order status via e-mail. All tracking information will be emailed to your KeepItDirect.ca ID once your order has shipped. You may also acquire your order status and other live updates by logging in to your account on our website.

Passwords and Security

Security is our number one priority. All on-line transactions are sent through our secure server and encrypted with SSL encryption software. Once we receive your information through the internet, only trusted, authorized employees will process the payment to make sure your information is handled with the utmost level of security.

Due to human error and other factors we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links or any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. Product Revisions

KeepItDirect.ca is not responsible for changes or variations in product specifications and/or physical appearance. In the interest of our customers, KeepItDirect.ca puts forth its best efforts to ensure that all product information is up-to-date and factual. Unfortunately there are various factors which, although infrequent, could cause the information on our website to become outdated without our immediate knowledge. Purchase Agreement

By accepting delivery of any product delivered from Keep It Direct Contractor Supply Ltd. ("KeepItDirect.ca"), you ("Customer") agree to be bound by the terms and conditions listed below. You and KeepItDirect.ca agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and KeepItDirect.ca. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change by KeepItDirect.ca at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from KeepItDirect.ca.

Product Return Procedure

KeepItDirect.ca will not accept returns without prior authorization.

If the order was received via courier or freight company:

The Customer must contact Returns@KeepItDirect.ca with their order number and what they would like to return. KeepItDirect.ca will arrange returns shipping of the product.

If the order was received via Canada Post: (2 options)

Option 1: The Customer can contact Returns@KeepItDirect.ca with their order number and what they would like to return. KeepItDirect.ca will arrange returns shipping of the product.

Option 2: The Customer can process the return using KeepItDirect.ca.

1. Log into www.keepitdirect.ca, then go to My Account.
2. Click Completed to see a list of all completed orders.
3. Find the order you wish to return, then click Return Item(s) next to View Order Details.
4. Fill out the following items on the return request:

Quantity to return
Return reason
Return action (optional)
Comments (optional)

5. Click Submit Return Request.

The Customer will receive an email with a return number and directions to the Canada post website where they can print their free shipping label to use at their nearest Canada post outlet.

Once KeepItDirect.ca confirms receipt and condition of the return, the Customer will be sent an email with the details of their return and the applicable refund will be processed.

The Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, KeepItDirect.ca's Return Procedure will be breached and KeepItDirect.ca may in its sole and absolute discretion reject the entire return or impose additional charges against the Customer for replacement of the missing component(s).

Warranties; All product sold "AS-IS" or "With All Faults"

KEEPITDIRECT.CA IS A DISTRIBUTOR AND IMPORTER. PRODUCTS SOLD BY KEEPITDIRECT.CA ARE NOT MANUFACTURED BY KEEPITDIRECT.CA. KEEPITDIRECT.CA MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. KEEPITDIRECT.CA DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. ALL ITEMS SOLD THROUGH KEEPITDIRECT.CA ARE SOLD "AS-IS" OR "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THESE ITEMS IS WITH THE BUYER. Limitation of Liability

IN ALL CIRCUMSTANCES KEEPITDIRECT.CA'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. KEEPITDIRECT.CA SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. KEEPITDIRECT.CA SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, SPECIAL DAMAGES OR EXEMPLARY DAMAGES, WHETHER OR NOT KEEPITDIRECT.CA HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Outages

KeepItDirect.ca periodically schedules system downtime for KeepItDirect.ca for maintenance and other purposes. Unplanned system outages also may occur. You agree that KeepItDirect.ca has no responsibility and is not liable for: (a) the unavailability of KeepItDirect.ca; (b) any loss of data, information or materials caused by such system outages; (c) the resultant delay, miss-delivery or non-delivery of data, information or materials caused by such system outages; or (d) any outages caused by any third parties, including without limitation any companies or servers hosting KeepItDirect.ca, any Internet service providers or otherwise.

Recordings

Keep It Direct Contractor Supply Ltd. does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. The Customer agrees not to record any call with Keep It Direct Contractor Supply Ltd. unless the Customer has provided clear and conspicuous notice to Keep It Direct Contractor Supply Ltd. and has received prior written consent from Keep It Direct Contractor Supply Ltd.

General Terms and Conditions:

Order Acceptance

An order is not binding upon KeepItDirect.ca until it is accepted; KeepItDirect.ca must receive payment before it will accept an order. The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Payment for product(s) ordered is due prior to shipment. The Customer can make payment by credit card or some other method prearranged and confirmed in writing with KeepItDirect.ca. KeepItDirect.ca reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any Customer. Verification of information may be required prior to the acceptance of an order. Prices and availability of products on KeepItDirect.ca are subject to change without notice. Errors will be corrected when discovered and KeepItDirect.ca reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). KeepItDirect.ca reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your account may also be restricted or terminated for any reason, at KeepItDirect.ca's sole discretion.

Shipping Charges

Your total cost for purchase of any product will include shipping and handling charges shown on the KeepItDirect.ca invoice.

Risk of Loss

KeepItDirect.ca will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. KeepItDirect.ca reserves a purchase money security interest in the product(s) until its receipt of the full amount due. The Customer agrees to allow KeepItDirect.ca to sign appropriate documents on the Customer's behalf to permit KeepItDirect.ca to protect its purchase money security interest. KeepItDirect.ca will advise the Customer of estimated shipping dates, but KeepItDirect.ca will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, provincial, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Applicable Law, Venue and Limitation of Actions

This section does not apply in the Province of Québec. These terms and conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia applicable to agreements made and entirely to be performed within the Province of British Columbia, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws. Regardless of where you access KeepItDirect.ca, you agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed and adjudicated only in the federal or provincial courts located in British Columbia (Vancouver Westminster Judicial District), and you hereby irrevocably and unconditionally consent and attorn to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of these terms and conditions.

Legal Equivalency

This electronic document and any other electronic documents, policies and guidelines incorporated herein will be: (i) deemed for all purposes to be a “writing” or “in writing,” and to comply with all statutory, contractual, and other legal requirements for a writing: (ii) legally enforceable as a signed writing as against the parties subject to the electronic documents; and (iii) deemed an “original” when printed from electronic records established and maintained in the ordinary course of business. Electronic documents introduced as evidence in any judicial, arbitration, mediation or administer of proceeding will, if established and maintained in the ordinary course of business, be admissible to the same extent as business records in written form that are similarly established and maintained.

Severability

If any provision contained in these Terms and Conditions is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions hereof, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Canadian law.

Waiver

The failure of either party to require performance by the other party of any provision of these Terms and Conditions shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in these Terms and Conditions shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement

These Terms and Conditions, together with KeepItDirect.ca's invoice regarding the products ordered by the Customer, are the complete and exclusive agreement between KeepItDirect.ca and the Customer, and they supersede all prior or contemporaneous proposals, understandings, representations, conditions, warranties, and all other communications between KeepItDirect.ca and the Customer relating to the subject products, whether oral or written. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage. The Customer and KeepItDirect.ca agree that these terms and conditions shall be entered into in the English language and interpreted in English.
